Hi Brian,
We use a standard MOU for all our partners. Previously, we provided a standard NDA, but our legal team requested we no longer provide the NDA as that agreement is between the students and our partners, and Babson shouldn't be part of it. My colleagues and I are pushing back on the NDA's. We would like to provide a generic template for our partners and students, we'll see how that goes!

Attached please find our MOU which does address intellectual property.

Hi Brian,
At Valencia College, we view NDAs as being between the employer and the student individually. The college is not a party to those obligations. We can make the NDA a requirement of a certain placement, but we do not advise students about the content of those documents or what the implications may be for signing. We let them know that they can seek their own legal counsel on the NDA If they wish. That might not be acceptable for some graduate level programs, but works for us.
When I worked for another institution as an internship faculty member, we used to caution students about reading any NDA carefully and helped them think through how they could talk about the experience that they were getting without violating it.

I know I need to take SEE's Legal Issues module, however, I need to advise our legal team as soon as possible on standard practices for MOUs between the university and the employer and NDAs between students and the employer. I have several questions:
  1. Would anyone be willing to share the Intellectual Property language you use for student project work?
  2. Do you have a policy as to whether students can sign employer NDAs or if they have to use university generated documents?
